What it is:
AI liability frameworks determine who bears legal and financial responsibility when AI systems cause harm. This can include economic damage such as wrongful denial of credit or employment, physical injury from autonomous vehicles or medical devices, or rights violations from discriminatory algorithmic decision-making. Current legal systems were designed for a world where humans make decisions and tools are predictable; AI disrupts this by introducing systems that operate with varying degrees of autonomy, learn and change their behavior after deployment, and make decisions whose reasoning may be opaque even to their developers. The core policy question is how to allocate responsibility across the AI value chain — among the developers who build models, the companies that deploy them, the users who direct them, and potentially the AI systems themselves.
Liability rules determine whether the costs of AI-driven disruption fall on firms or on the workers and consumers they affect. Under a weak liability regime, a company can deploy an AI system that eliminates jobs or makes harmful errors with little financial risk. Under stronger liability regimes, where developers and deployers face meaningful financial risk, they have reason to invest in safety, maintain human oversight, and slow deployment in high-stakes domains. Mandatory insurance requirements could price this risk explicitly, ensuring the cost of potential harm is factored into deployment decisions rather than discovered after the fact. The design of liability rules is thus a lever for determining how the efficiency gains from AI are distributed, and whether displaced workers have any mechanism to recover a share of the value extracted from their economic position.
The challenge:
The difficulty is that AI fits poorly into existing legal categories. Software has historically been treated as a service rather than a product, shielding it from strict product liability. And when an AI system causes harm, the cause may be untraceable: a flaw in training data, a deployer's configuration error, or an unpredictable interaction with real-world conditions. This opacity advantages defendants: plaintiffs cannot prove what they cannot see. Strict liability would shift this burden, but raises additional concerns about chilling investment or pushing development to weaker jurisdictions. And liability rules that emerge piecemeal through litigation will reflect the cases that get brought — likely high-profile physical harms rather than diffuse economic displacement — potentially leaving the workers most affected by AI with the weakest legal recourse.
